CONDENSED ToS
Just a disclaimer, this is a short version of ToS and some details will be missing here. Use the condensed version to grasp the most important information. However, before placing an order I highly suggest you read the full ToS as the points stated in there will apply to the commission. :^)
✧ I only use PayPal invoices to receive payments and only accept payments in USD.✧ For orders at or below $50 payment upfront is required.✧ For orders above $50 you pay 50% of the price after we agree on what you want to see in your drawing and the rest once the sketch is finalised and approved by you.✧ You can’t use the art for commercial purposes unless we discuss it separately beforehand.✧ The approximate date of completion is 2 weeks after the second payment has been sent.✧ You can get a full refund if I haven’t started working on the project, 80% refund if I did the sketch and 30% refund if the line art is complete.✧ You will also get a full refund if for whatever reason I haven’t finished your art in 90 days.✧ I can refuse to continue working with clients for whatever reason and in that case I do a full refund.✧ You have the right for 3 revisions in the sketching phase.✧ After the work is done you can only ask for mild changes like an eye color. That is unless I make a mistake in the design of your character - in that case I will gladly change that free of charge.✧ By ordering an NSFW art you agree that you are at least 18 years old!!!✧ You need to communicate with me in a timely and responsive manner so that your art can be the best version of itself!✧ You CANNOT use the art in any blockchain-related technology or for AI tools or datasets.
Now, to the formal stuff:
TERMS OF SERVICE

This contract applies to the artist further called the Artist and person or institution further called Client purchasing from the Artist a work of art further called Artwork. By ordering Artwork from the Artist the Client agrees to the following terms and conditions:SECTION I. IMAGE COPYRIGHT
1.1. The Artist retains full and exclusive rights to the original Artwork. The Client may not claim it as their own or use it for anything other than personal use.
1.2. The Artwork is for personal use only. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Artist. Those cases will require a separate agreement between the Client and the Artist defining exact conditions and financial implications of such use of the Product.
1.3. The Client is permitted to repost the Artwork wherever they would like, on the condition that proper credit is given and the Artist’s watermark/signature remains intact and unaltered.
1.4. Prohibited Actions
1.4.1 Altering the Artwork in any way without asking for permission beforehand, with the exception of cropping/resizing the image for an icon or other use.
1.4.2 Use the Artwork as references, whether tracing or re-purposing parts of the image.
1.4.3 Claiming the Artwork as made by the Client.
1.5. The Client does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
1.6. In addition, the Client does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.
1.7. If these terms are broken, the Client will be privately blacklisted from commissioning the Artist.SECTION II. PAYMENT INFORMATION
2.1. Payment is accepted in USD. All USD payments will be taken via Paypal via invoices only.
2.2. The Client agrees to pay the due amount upfront for any orders of value lower or equal to $50.
2.3. On orders above $50 the Client agrees to pay half the invoice total upfront. The other half has to be paid on approval of the initial sketch.
2.4. It is the Client’s responsibility to inform the Artist when the payment has been sent.
2.5. The Client accepts that work will not commence until payment has been received by the Artist according to the above schedule.SECTION III. REFUND POLICY
3.1. If the Artwork is cancelled by either side before work has started the Client receives a full refund.
3.2. If the Client cancels the Artwork during progress, the amount refunded will be on the following basis:
3.2.1. Sketch: 80%
3.2.2. Line: 30%
3.2.3. Flat Color: 0%
3.3. No refunds will be given for completed or nearly completed commissions.
3.4. The Artist reserves the right to cancel the Artwork at any time, for any reason, and without explanation.
3.5. If the Artist cancels the Artwork due to inability to complete it at any state, a full refund will be given.SECTION IV. CONTACT AND COMMUNICATION
4.1. Discussion of the Artwork can be conducted via e-mail ([email protected]) or Discord (choxxer).
4.2. The Client obliges to respond to any requests for comments, clarifications, opinions, validation of progress etc in 24 hours. Lack of timely communication on behalf of the Client will be recognized as implicit approval of all work progress and current state of the Artwork.
4.3. Upon completion, the finished digital Artwork can be delivered in the form of an email containing the file in full resolution to the e-mail address provided by the Client or via a link to a Google Drive folder where the Artwork will be stored.SECTION V. VISUAL REFERENCE GUIDELINES
5.1. The Client must provide at least one clear and concise visual reference and any important information the Artist may need to know to correctly draw the character or characters. Any pose, emotion or background references, if any, should be sent as well.
5.2. If a link to a gallery of the character’s artwork is sent, the Artist cannot promise 100% accuracy of the design as design interpretations may be inconsistent between images and lessen the Artist´s ability to accurately draw the character.
5.3. An artwork done solely on descriptions may be discussed but will be subject to an extra fee as it will be considered a character design project.SECTION VI. REVISIONS
6.1. The Artist will rely heavily on the scene or pose provided by the Client, but certain variations are to be expected.
6.2. The Client has the right to 3 complete revisions in the sketching phase. Those include but are not limited to: pose (whether a part of it on as a whole), emotion, background.
6.3. After the sketch has been approved, no major edits or changes will be made. If the Client requests additional edits after the approved sketch, a price for the edits may be discussed.
6.4. If the Artist makes any errors in the character design, accessories, or any other visual elements specified in the provided visual references, the Artist obliges to make these edits at no additional cost.
6.5. The Client has right to a reasonable amount of minor edits after completion, such as changing an eyecolour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.SECTION VII. ESTIMATED DATE OF COMPLETION
7.1. Estimated date of completion is 2 weeks (14 days) starting from the day the final payment has been sent. If there are any delays in completion of a commission, the Artist obliges to personally notify the Client.
7.2. If for any reason the Artist cannot complete the Artwork within 90 days of ordering, the Artist issues a full refund.SECTION VIII. WORK IN PROGRESS
8.1. By default the Artist has the right to post WIPs or videos that include the work on the Artwork to their social media platforms. If the client doesn’t want the Artwork to be posted anywhere whether during the process or upon completion they must state so before the work on the Artwork starts.
8.2. The Client can ask for WIPs during any stage of the process but not sooner than every 2 days.
8.3. The Client cannot ask to edit anything they see in WIPs unless it is an incorrect portrayal of the design they have sent during the negotiation phase.SECTION IX. LIST OF ACCEPTABLE SUBJECTS
9.1. The list below provides topics that the Artist is willing or not willing to depict. In case the Client has any questions regarding its contents they can ask the Artist about their specific subject via e-mail or Discord.
9.2. The Artist will not emulate other artist’s styles and will work exclusively in the artstyle presented in the Artist’s social media platforms.
9.3. The Artist works on both SFW and NSFW projects. By commissioning an NSFW artwork the Client agrees that they are at or above the age of 18 years old.
9.4. The Artist is willing to depict in both SFW and NSFW artworks:
• Humans;
• Furries/Anthro;
• Robots/Cyborgs;
• Other creatures (must be discussed with the Artist beforehand);
• Fanarts;
• Complex backgrounds;
• Up to 4 characters in an artwork;
• Mild gore (no dismemberment or missing body parts);
• Violence.
9.5. The Artist is not willing to depict in both SFW and NSFW artworks:
• Real people shipping;
• Gore;
• Minors by age and/or appearance performing romantic and sexual actions or being the subject of violence;
• Animals performing romantic and sexual actions or being the subject of violence;
• Hateful or discriminatory content including but not limited to: racism, homophobia, transphobia, ableism etc.
9.6. The Artist is willing to depict in NSFW artworks:
• The majority of kinks and fetishes;
• Up to 3 characters engaging in the same act.
9.7. The Artist is not willing to depict in NSFW artworks:
• Minors or characters with an appearance of a minor;
• Bestiality;
• Non-consensual acts;
• Scat.
